if i have standard foz STI parts fitted to an XT can they legally defect you for modified engine emissions when the STI's emissions are fine?

Technically, they can defect you for whatever they wish, unfortunately, then it's up to you to get it cleared.

The Forester STI's emissions are to Japanese spec, using Japanese fuel, as the car was JDM.

You'll be tested against AUDM regulations, irrespective of the modifications.

FWIW, I've got plenty of JDM parts on mine, though mainly not engine/exhaust parts. Not that I've deliberately tried to avoid them, just that in my case I've not found anything specific or necessary.

Unfortunately ignorance is allowed when police issue defects as they aren't experts in vehicle modification rules and they shouldn't be.
So if they think something might be unsafe or breaching the modification rules, they can defect it.
Only if you have an engineers report showing that it is meets all regs or you can show that it's within the rules that you can refuse it. - ie: if you have non standard wheels/tyres but they fit within the legal limits, keep the rules printed in your glove box and go over it with the officer if they are ever "trying it on".

But from my experience, this is only ever an issue if you are being an idiot on the road. Or possibly just hanging out with people and the officers think you have a high potential for being an idiot later :)
